1. Introduction

GrowthFactor, Inc. ("the Company," "we," "us," or "our") operates the website growthfactorlabs.com (the "Service"). The Company builds and operates an AI-powered site-selection platform for retail chains: the Service ingests aggregated foot traffic data, local spending demand signals, and client store-portfolio geometry to score candidate retail locations and identify cannibalization risk. This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to information we collect through the Service and through direct communications with you.

2. Information We Collect

2.1 Information You Provide

We collect information you submit directly, including:

• Contact details (name, company name, email address, phone number) when you fill out a demo request form, contact us, or subscribe to Insights updates;
• Business context you choose to share, such as your role, number of store locations, and the markets you are evaluating;
• Candidate site addresses or geographic coordinates submitted through the Service for evaluation;
• Your existing store-portfolio data (store addresses, trade-area boundaries) when you upload it so the platform can model cannibalization risk;
• The content of any messages you send us.

2.2 Platform Data We Process on Your Behalf

When you use the GrowthFactor platform to evaluate retail locations, we process the following categories of data to generate your site reports:

• Aggregated, panel-normalized mobile foot traffic data for candidate trade areas, sourced from opted-in consumer devices;
• Local consumer spending demand data by retail category, derived from anonymized credit and debit transaction aggregates at the zip-code level;
• U.S. Census and American Community Survey demographic and income data for trade-area delineation;
• Competitor proximity data reflecting the density and placement of category competitors near candidate sites;
• Your submitted store-portfolio geometry, used solely to model cannibalization overlap between proposed and existing locations.

The foot traffic and spending datasets we use contain no individual-level identifiable information. They are pre-aggregated by our data suppliers before we receive them. Your submitted portfolio data is used only to generate your reports and is not combined with other clients' data.

2.3 Information Collected Automatically

When you visit growthfactorlabs.com, we automatically collect limited technical information:

• IP address and approximate location (city or region level);
• Browser type, operating system, device class;
• Pages visited, referring URLs, time on page;
• Cookie and similar identifiers (see Section 5 and our Cookie Policy).

2.4 We Do Not Knowingly Collect Children's Data

growthfactorlabs.com is a business-to-business service not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact [email protected] and we will delete it.

3. How We Use Information

We use the information we collect to:

• Respond to demo requests and inquiries from retail real estate and expansion teams;
• Operate and deliver the GrowthFactor site-scoring platform, including generating location reports and cannibalization risk analyses for your submitted candidate sites;
• Maintain and improve our foot traffic normalization models, demand scoring methodology, and platform accuracy;
• Send service updates, platform release notes, and (with your consent where required) Insights content about retail site-selection strategy;
• Detect, investigate, and prevent misuse of the platform;
• Comply with legal obligations.

We do not use your submitted store-portfolio data or candidate-site submissions to train or improve our underlying models without your explicit written consent. We do not sell personal information for monetary value. Where applicable state law treats certain advertising arrangements as a "sale" or "share," see your state's section below.

4. Sharing of Information

We share personal information only with:

• Service providers acting on our behalf (such as cloud hosting, transactional email delivery, and anonymized site-usage analytics) under contractual confidentiality terms that prohibit them from using the data for their own purposes;
• Data suppliers who provide the foot traffic, spending, and demographic datasets the platform relies on, under data-processing agreements;
• Legal authorities, when required by law or court order, or to protect the rights, safety, or property of the Company or others;
• A successor entity in the event of a merger, acquisition, or asset sale, subject to this Policy.

We do not sell personal information to third parties. We do not share client store-portfolio data or candidate-site submissions with any third party outside the service-provider relationships described above.

5. Cookies and Tracking

We use cookies and similar technologies to operate the site, remember preferences, and measure usage. For details and your choices, see our Cookie Policy.

6. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy and to comply with legal or accounting obligations. Contact and inquiry records are retained for 36 months after last interaction, reflecting the long sales cycles typical in retail real estate decisions. Submitted store-portfolio data and site-evaluation inputs are retained for the duration of your active account and for 12 months after account closure. Inactive marketing-list contacts are purged after 24 months. Server access logs are retained 90 days, then aggregated.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, restricted-access cloud databases, least-privilege access controls, and separation of client data by account. No system is perfectly secure; we cannot guarantee absolute security. If you believe a security incident has occurred, please notify us promptly at [email protected].

8. Your General Rights

Depending on your jurisdiction, you may have rights including access, correction, deletion, and the ability to limit certain processing. To make a request, email [email protected]. We will respond within the timeframe required by applicable law.

9. Minnesota Residents

Minnesota does not currently have a comprehensive consumer privacy statute. As a matter of policy, the Company extends the following baseline rights to all U.S. residents regardless of state of residence.

9.1 Baseline Rights

• Right to Know: request the categories of personal information we have collected about you.
• Right to Delete: request deletion of personal information you have provided.
• Right to Correct: request correction of inaccurate personal information.
• Right to Opt Out of Marketing: unsubscribe from marketing emails or opt out via the link in each marketing message.

9.2 How to Exercise

Email [email protected] with a description of your request and enough detail for us to verify your identity. We respond within 45 days.

9.3 Sector-Specific Rights

If you are protected by federal sector laws (such as GLBA or FERPA), those laws may give you additional rights with respect to data covered by them.

9.4 California Visitors

If you are a California resident, you may also exercise the rights granted under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. The Company does not sell personal information and does not "share" personal information for cross-context behavioral advertising.
